In re Google Referrer Header Privacy Litigation (Ninth Circuit)
Google successfully defended the district court’s approval of a class-wide settlement in this Internet privacy case. The objectors argued for new and rigid limits on the discretion of district courts to accept cy pres settlements of class actions. The Ninth Circuit rejected this invitation and agreed with our position that it is appropriate to direct settlement funds to support of the work of qualified academic institutions and nonprofit organizations when monetary distribution to class members is infeasible.
