DirecTV, LLC v. Hall (U.S. Supreme Court)
Pursuant to Department of Labor regulations, courts have long applied a “joint employer” analysis to determine whether an employee’s work for multiple employers should be aggregated for purposes of the Fair Labor Standards Act (FLSA). In this putative FLSA class action, the Fourth Circuit applied its own, new test for joint employment that differs dramatically from the test used by other courts of appeals. We are seeking certiorari to review that decision, on the ground that the Fourth Circuit’s test misinterprets the law and improperly subjects commonplace, legitimate contracting arrangements to joint-employment liability under the FLSA.
